Terms of Service
1. Who we are
Cafizio is a point-of-sale app for cafes developed and sold by Marocraft LLC, 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, USA. Support: contact@cafizio.com. These terms are an agreement between you and Marocraft LLC ("Cafizio", "we", "us").
2. Acceptance of terms
By accessing or using the Cafizio website and apps (the "Service"), you agree to be bound by these terms. If you disagree with any part of them, you may not access the Service.
3. Accounts
When you create an account with us, you must provide accurate, complete, and current information at all times. Failing to do so may result in the suspension or termination of your account. You are responsible for safeguarding the credentials you use to access the Service and for all activity under them. Notify us immediately of any security breach or unauthorized use of your account.
4. License
A Cafizio POS license is a one-time purchase that grants you a lifetime, non-exclusive, non-transferable right to run the Cafizio POS app on one device. The license is tied to the device it is activated on and cannot be moved to another device. It includes all future updates of the POS app at no extra cost. The license does not include the cloud subscription beyond the 3 free months described below.
5. Cloud subscription
The cloud subscription is optional. It adds remote monitoring of sales, stock, and staff from the Manager app; the POS app works fully without it. It is sold as prepaid packs for a fixed number of days (for example 31, 184, or 365 days). Packs never renew automatically and we never charge you without a new purchase. When a pack ends, remote monitoring pauses until you buy a new pack; your POS license keeps working. Every license includes 3 free months of the cloud subscription.
6. Payments
Prices are shown in US dollars; our payment provider may display a localized amount at checkout. Payments are processed by Paddle, which acts as the merchant of record for the order and provides the receipt. Cafizio never receives or stores your card details. Refunds are handled under our Refund Policy.
7. Free trial
Cafizio POS offers a 15-day free trial with all features and no payment card required. The trial ends automatically after 15 days without any charge; to continue, you purchase a license.
8. Intellectual property
The Service and its original content, features, and functionality are and will remain the exclusive property of Marocraft LLC and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and other countries. Our trademarks may not be used in connection with any product or service without our prior written consent.
9. Links to other websites
Our Service may contain links to third-party websites or services that we do not own or control. We assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
10. Termination
We may suspend or terminate your access to the Service if you breach these terms. A validly purchased license is not revoked for reasons unrelated to a breach. Upon termination for breach, your right to use the Service ceases immediately.
11. Limitation of liability
To the fullest extent permitted by law, Marocraft LLC, its directors, employees, partners, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, use, or goodwill — resulting from (1) your access to, use of, or inability to use the Service; (2) any conduct or content of any third party on the Service; or (3) unauthorized access, use, or alteration of your transmissions or content. Our total liability for any claim is limited to the amount you paid us for the product concerned.
12. Governing law
These terms are governed by the laws of the State of New Mexico, United States of America, without regard to its conflict-of-law rules. Any dispute that cannot be resolved amicably will be brought before the competent courts of that jurisdiction, unless mandatory consumer-protection law in your country of residence provides otherwise.
13. Changes
We reserve the right to modify or replace these terms at any time. We will try to give at least 30 days' notice before any new terms take effect. Continuing to use the Service after revisions become effective means you agree to the revised terms.
